Labor Law

Employment Regulation File due to economic, production or organizational causes

A Spanish multinational needed to optimize the labor structure of one of its most important industrial plants. It was decided to study the possibility of implementing a Workforce Adjustment Plan for Economic, Production-Related, or Organizational Reasons.

Despite the fact that labor relations were very well managed through both official and unofficial channels, implementing a Workforce Adjustment Plan for hundreds of people requires that all aspects be perfectly handled.

We first studied the economic and production-related causes. Although both were very clear, the production-related cause allowed us to perfectly define the cause and the impact. For this reason, we ruled out using both economic and technical causes.

We studied area by area and department by department to identify which parts of the organization had redundancies. We then studied each redundancy to finally identify the positions that were likely to be eliminated.

We compared this preliminary study with various areas of the company, both business and support. And finally, in coordination with legal counsel, we held meetings with the unions to present the study and the consequent plan that we had carried out.

Shortly thereafter, the Workforce Adjustment Plan was executed as planned without any relevant problems.
